Terms of Service

These Terms of Service (“Terms”) form a legal contract between you and [PLACEHOLDER — legal entity name, e.g. Calibre Labs Inc.] (“Calibre,” “we,” “us,” “our”). They govern your access to and use of our website at caliber.photos and our AI photo-generation service (together, the “Service”).

By creating an account, starting a subscription, or otherwise using the Service, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and these Terms apply to it as well.

You must be at least 18 years old to use Calibre. The Service is designed for adults creating photos of themselves for personal dating profiles. We do not knowingly provide the Service to anyone under 18, and we do not generate photos involving minors under any circumstances.

You represent and warrant that: (a) you meet the age requirement above; (b) you are not located in a country subject to a U.S. government embargo or on any government restricted-party list; and (c) your use of the Service does not violate any law applicable to you.

You need an account to use the Service. When you register, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Notify us immediately at support@caliber.photos if you suspect unauthorized access to your account. We are not liable for losses caused by unauthorized use of your account where you have failed to safeguard your credentials.

You may not share, sell, or transfer your account or credentials to another person. Each account is for the sole use of the individual who registered it.

Calibre uses AI models to generate photo-realistic images based on selfies you upload. The resulting images are AI-generated imagery — they are not photographs taken by a camera. They are built to look natural and true to your appearance, but they do not depict actual events or places.

You agree not to present Calibre-generated images in any context where AI-generated content is prohibited, or in a way that is deceptive or unlawful (including violating the terms of any dating platform on which you use them).

Results vary depending on the quality and variety of the photos you provide and other factors. We do not guarantee any particular outcome — including number of matches, dates, or other results — from using your photos.

Uploads.You retain ownership of the selfies and other photos (“Uploads”) you provide to the Service. By uploading them, you grant Calibre a limited, non-exclusive, worldwide, royalty-free license to access, store, process, and transmit your Uploads solely to generate your photos, to maintain the Service, and to comply with legal obligations. We will not use your Uploads for any other purpose, including to train AI models for third-party use or to advertise the Service without your explicit consent.

Biometric data. Your selfies may contain biometric identifiers (including facial geometry data). By uploading selfies, you consent to Calibre and its AI processing sub-processors using that data to generate your requested photos. We do not sell biometric data. You may request deletion of your Uploads and associated data at any time, as described in our Privacy Policy.

Generated outputs.As between you and Calibre, the AI-generated photos we produce for you (“Outputs”) are yours to use for your dating profiles and other personal, non-commercial purposes. We do not claim ownership of your Outputs. This license to your Outputs is conditioned on your active subscription and your compliance with these Terms.

You confirm that all Uploads:

• are photographs of you, and you have all rights necessary to upload them;
• do not depict any other person without their explicit consent, and do not depict any minor under any circumstances;
• do not infringe any copyright, trademark, or other third-party right;
• are not in violation of any law.

Calibre is for creating your own dating profile photos — nothing more. You agree not to use the Service to:

• upload images of anyone other than yourself, or images of a minor under any circumstances;
• impersonate another real person, create misleading images of an identifiable individual, or generate images intended to harass, defame, or harm any person;
• generate sexual, violent, hateful, or otherwise unlawful or harmful content;
• use the Service to commit fraud, run scams, create fake profiles, or deceive anyone as to your identity;
• violate the terms of service of any dating platform or other site on which you use Calibre Outputs;
• access the Service by automated means (bots, scripts, crawlers) without our written permission;
• reverse engineer, decompile, or attempt to extract the source code, models, or trade secrets underlying the Service;
• resell, sublicense, or commercially exploit the Service or Outputs without our written consent;
• interfere with the proper functioning of the Service or the infrastructure it runs on.

Violation of these rules may result in immediate suspension or termination of your account and, where required, reporting to law enforcement.

Calibre is available as a monthly auto-renewing subscription. The key billing terms:

• Auto-renewal. Your subscription renews automatically each month on your billing date unless you cancel before that date.
• Cancellation. You can cancel at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current paid period. You retain access and your remaining credits until then; no partial refunds are given for unused time except as described in our Refund Policy.
• Price changes.We may change subscription prices. We will give you at least 30 days' advance notice of any price change affecting your subscription, by email or within the Service. Continuing to subscribe after the price change takes effect constitutes your acceptance of the new price.
• Payment processing. Payments are processed by Dodo Payments, which acts as the Merchant of Record (seller of record) for all subscriptions. Dodo Payments handles payment processing, tax collection and remittance, receipt issuance, refunds, and billing on our behalf. By subscribing, you authorise Dodo Payments to charge your payment method on a recurring monthly basis. We do not store your full card details.
• Taxes. Because Dodo Payments is the Merchant of Record, applicable taxes (VAT, GST, sales tax, etc.) are calculated and collected by Dodo Payments at checkout based on your location. Prices shown may be exclusive of tax; the final amount charged will include any applicable taxes.
• Failed payments. If a payment fails, we may retry the charge and/or suspend access to the Service until payment is received.

Each subscription plan includes a monthly allotment of credits. Credits are the in-Service currency used to generate photos (one generation batch costs a set number of credits).

• Credits are allocated at the start of each billing cycle and expire at the end of that cycle — unused credits do not roll over to the next month.
• Credits are tied to your account, are for your personal use only, and are non-transferable.
• Credits have no cash value and cannot be exchanged for money or applied as a credit toward future subscriptions.
• If you upgrade or downgrade your plan mid-cycle, your credit balance will be adjusted in line with the new plan tier.

We back the Service with a 14-day money-back satisfaction guarantee on your first payment. Full details — including how to qualify, how to request, and what happens to your credits — are in our Refund Policy.

Renewal payments after the first billing cycle are generally non-refundable. Refunds for renewal cycles may be considered at our discretion in exceptional circumstances.

The Calibre name, logo, website, software, AI models, prompt systems, and all other technology and content underlying the Service are owned by Calibre or licensed to us and are protected by copyright, trademark, and other intellectual-property laws.

These Terms grant you a limited, personal, non-transferable, revocable right to use the Service as described here. They do not transfer any ownership of our technology or brand to you. You may not use our name, logo, or trademarks without our prior written consent.

The Service is provided “as is” and “as available.” To the fullest extent permitted by applicable law, Calibre disclaims all warranties — express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that: (a) the Service will be uninterrupted, timely, or error-free; (b) defects will be corrected; (c) the Service or the infrastructure it runs on are free of viruses or other harmful components; or (d) your generated photos will produce any particular outcome on a dating platform.

Some jurisdictions do not allow certain warranty exclusions. Where this is the case, those exclusions apply only to the extent permitted by law.

To the fullest extent permitted by applicable law, Calibre and its directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising out of or relating to the Service is limited to the amount you paid us in the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded or limited by applicable law, such as liability for fraud or personal injury caused by our negligence.

You agree to defend, indemnify, and hold harmless Calibre and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service in violation of these Terms; (b) your Uploads or the content you provide; (c) your violation of any third-party right; or (d) your violation of any applicable law or regulation.

By you. You may stop using the Service and cancel your subscription at any time. Cancellation ends future billing; you retain access through the end of your current paid period.

By us. We may suspend or terminate your access to the Service at any time, with or without notice, if: (a) you violate these Terms; (b) we are required to do so by law; (c) we determine that continued access poses a risk of harm to other users or to the Service; or (d) we discontinue the Service.

On termination for cause (i.e., your breach), you forfeit any remaining credits and we are not obligated to issue a refund. On termination without cause by us, we will issue a pro-rated refund of your current billing period.

Sections on Acceptable Use, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

We may modify these Terms at any time. For material changes, we will update the “Last updated” date at the top and notify you by email or in the Service with at least 14 days' notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to any material change, cancel your subscription before the change takes effect.

These Terms are governed by the laws of [PLACEHOLDER — jurisdiction, e.g. the State of Delaware, USA], without regard to its conflict-of-laws rules. You and Calibre agree that any legal dispute arising out of these Terms or the Service will be resolved exclusively in the courts of [PLACEHOLDER — courts, e.g. the state or federal courts located in Delaware], and each party consents to personal jurisdiction there.

Informal resolution first. Before filing any formal legal claim, you agree to contact us at legal@caliber.photos and give us 30 days to try to resolve the issue informally.

Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Calibre regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction (for example, in the event of a merger or acquisition), subject to this policy continuing to apply to your data.
